  1. INTRODUCTION:

Welcome to Sokher Bazar. The following terms with SOKHER BAZAR are accepted by you when you use the SOKHER BAZAR website and any associated service or tool: For any inquiries, kindly get in touch with customer support.

Throughout these “Terms and Conditions,” which are meant to be a “User Agreement,” “SOKHER BAZAR” is referred to both individually and collectively as “we” or “us.”

  1. SCOPE:

You must read and agree to all of the conditions in this “Terms and Conditions” (also known as the “User Agreement”) and the SOKHER BAZAR User Privacy Policy before using the SOKHER BAZAR services. It is highly recommended that you access and study the content that is hyperlinked while you read this User Agreement. Accepting this User Agreement means that you understand that it will be applicable any time you use the SOKHER BAZAR services or any tools we provide to interact with them, together with the User Privacy Policy.

When you utilize some SOKHER BAZAR services, we may present you with extra or different terms.

  1. COPYRIGHT AND OTHER RIGHTS:

All content, including text, graphics, logos, button icons, pictures, audio clips, digital downloads, and data compilations, that is part of or accessible via any SOKHER BAZAR service is owned by SOKHER BAZAR or its content providers and is safeguarded by SOKHER BAZAR.

You may not copy, extract, and/or re-use any content from any SOKHER BAZAR Service without our express written consent, excluding the content that is required to use the service for its intended purpose and in compliance with these conditions of use and the applicable service terms. This includes, but is not limited to, product listings, descriptions, prices, and account information. Specifically, without our prior written approval, you are not permitted to use any data mining, robots, or comparable data collection and extraction techniques to extract (one time or repeatedly) any significant portions of any SOKHER BAZAR service or its content for re-use. Additionally, without our prior written authorization, you are not permitted to build and/or publish your own database that incorporates significant portions of any SOKHER BAZAR service or its content.

  1. YOUR ACCOUNT:

You bear the responsibility of keeping your password and account private. We are not liable for unauthorized access to or use of your password or account. You are in charge of all activities that happen under your account, unless they are carried out or approved by you, with the exception of the extent that our violation of this Agreement results in such activities. You should take all necessary precautions to guarantee that your password is kept private and secure. You should also notify us right away if you suspect that someone else knows your password or if it is being used, or is likely to be used, in an unauthorized way. It is your responsibility to make sure the information you give us is accurate and up to date, and to notify us of any changes. In the website’s Manage Account section, you have the ability to view and modify specific data that you have given us as well as your account preferences.

You may not use any SOKHER BAZAR Service:

  • in any way that causes, or is likely to cause, any SOKHER BAZAR Service, or any access to it to be interrupted, damaged or impaired in any way,
  • in any way that may interfere with or harm any other user of an SOKHER BAZAR Service;
  • for fraudulent purposes, or in connection with a criminal or other unlawful activity, or
  • in any manner that is not permitted under these Conditions of Use and the relevant Service Terms.

If we have concerns with your account, or activity relating to your account, or if you are in breach of applicable laws, these Conditions of Use, or the relevant Service Terms, we reserve the right to take action on your account in accordance with these Conditions of Use, and the relevant Service Terms, including without limitation by

  • refusing service,
  • suspending or restricting access to your account,
  • terminating your account; or
  • removing or editing content you post using your account. The action we elect to take and any notice you may receive will vary depending on the SOKHER BAZAR Service, the circumstances and our assessment of relevant factors. Suspension or termination of a SOKHER BAZAR Service may occur in connection with, or result in suspension or termination of other SOKHER BAZAR Services. At any time, you may, in accordance with the applicable Service Terms and using the tools and settings we make available to you for each SOKHER BAZAR Service, cease using any SOKHER BAZAR Service, terminate your account or the SOKHER BAZAR Service, or remove or edit certain content and material you post.
  1. REVIEWS, COMMENTS, COMMUNICATIONS AND OTHER CONTENT:

As long as the content is not unlawful, vulgar, abusive, threatening, defamatory, invading someone’s privacy, violating intellectual property rights, or otherwise harmful to third parties or objectionable, visitors are free to post reviews, comments, and other content, communicate, and submit suggestions, ideas, questions, or other materials. You are not allowed to email or upload any material that includes software viruses, political campaigning, chain letters, bulk mailings, commercial solicitations, or any kind of “spam.” It is prohibited to adopt a fictitious email address, pose as someone else, or give any other misleading impression about the source of any such communication or content. We reserve the right to alter or remove such content, but we are under no obligation to do so.

Unless we specifically state otherwise, you grant SOKHER BAZAR the following rights if you post content or submit material: (a) SOKHER BAZAR non-exclusive, royalty-free, fully sublicensed and transferable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide in any media; and (b) SOKHER BAZAR, its sublicenses, and transferees the right to use the name that you submit in connection with such content.

You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such content and material. To the extent permitted by law, as applicable, you:

  • consent to any infringement of; and
  • agree to waive, any right you have to be identified as the author of such content and any right you have to object to derogatory treatment of such content. You agree to perform all further acts necessary to perfect any of the above rights granted by you to SOKHER BAZAR, at our request.

You are responsible for your content and you represent and warrant that you own or otherwise control all of the rights to the content and material that you post and that, as at the date that the content or material is posted it:

  • is accurate;
  • complies with these Conditions of Use and any applicable Service Terms; and
  • does not breach any applicable laws. You agree to indemnify SOKHER BAZAR for all claims brought by a third party against SOKHER BAZAR arising out of or in connection with the content and material you supply except to the extent that any liability arises from our failure to remove the content or material when we receive from a relevant party a valid Notice Form as described in these conditions relating to the content or material.
  1. USING SOKHER BAZAR:

While using the SOKHER BAZAR services, you will not:

1• post content or items in our sites and services;

2• infringe any laws, third party rights or our policies, such as the prohibited and restricted items policies;

3• use the SOKHER BAZAR services if you are not able to form legally binding contracts, are under the age of 18 or are suspended from using the SOKHER BAZAR services;

4• manipulate the price of any item or interfere with other users’ listings;

5• circumvent or manipulate our fee structure, the billing process, or fees owed to SOKHER BAZAR;

6• post false, inaccurate, misleading, defamatory or offensive content (including personal information);

7• take any action that may undermine the Feedback or ratings systems (such as displaying, importing or exporting Feedback information or using it for purposes unrelated to SOKHER BAZAR);

8• transfer your SOKHER BAZAR account (including Feedback) and user ID to another party without our consent;

9• distribute or post spam, unsolicited or bulk electronic communications, chain letters or pyramid schemes;

10• distribute viruses or any other technologies that may harm SOKHER BAZAR or the interests or property of SOKHER BAZAR users;

11• export or re-export any SOKHER BAZAR tools except in compliance with the export control laws of any relevant jurisdictions;

12• copy, modify or distribute rights or content from the SOKHER BAZAR services or SOKHER BAZAR copyrights and trademarks; or

13• harvest or otherwise collect information about users, including email addresses, without their consent.

  1. ABUSING SOKHER BAZAR:

In order to keep our websites and services operating efficiently and the community safe, SOKHER BAZAR and its user base (referred to as “the community”) collaborate. Kindly notify us of issues, objectionable material, and transgressions of our policies.

Contact our support team and we will look into any claims you have made that your intellectual property rights have been infringed. In addition to other remedies available to us, we may restrict, suspend, or terminate user accounts and our service; forbid access to SOKHER BAZAR services; delay or remove hosted content; remove, delete, modify, or not display listings; charge fees and/or recover our costs for policy monitoring and enforcement; and/or take technological and legal measures to prevent users from using our sites if we believe they are causing issues, posing a risk of legal trouble, violating the intellectual property rights of others, or acting contrary to our policies. Furthermore, we reserve the right to suspend or terminate the accounts of users who may repeatedly violate the intellectual property rights of third parties, in suitable circumstances and at our reasonable discretion. Additionally, we retain the right to change or stop offering SOKHER BAZAR services, as well as to cancel unverified accounts or accounts that have been inactive for an extended period of time.

  1. CHILDREN:

We don’t sell goods to kids for purchase. We sell things for kids, homes, kitchens, electronics, and fashion that adults can buy. You may only utilize the SOKHER BAZAR services if your parent or legal guardian is present if you are under the age of 18.

  1. FEES AND SERVICES:

It costs nothing to browse or join SOKHER BAZAR. All costs and pricing are provided in Bangladeshi Taka unless otherwise specified. You are in charge of promptly paying any costs and all relevant taxes related to our websites and services using a legitimate payment method. If there are any additional fees that need to be added to your order invoice, you will be informed by phone, SMS, or email.

  1. SHIPPING CHARGES:

Product type, quantity, delivery method, shipping location, and other factors all affect shipping costs. Shipping charges are billed separately on each order invoice. If there are any extra shipping costs, we will let you know (by phone, email, or SMS) before we ship out your item. The ‘Checkout’ page displays the standard delivery costs.

  1. PRODUCT DELIVERY:

On the campaign details (‘Offer Detail’) page, you can find the specific product distribution system for each campaign. Following the campaign’s conclusion, we typically ship or deliver your order within two business days. We will deliver or ship your order within two working days if it does not include any products that are currently part of an ongoing campaign. Any significant event—a massive promotion, political upheaval, a political event, national or public holidays, etc.—may cause delivery or shipping to take longer.

  1. ORDER CANCELLATION:

Prior to shipment, SOKHER BAZAR maintains the absolute right to cancel any order at its sole discretion for any reason, including but not limited to the product being mispriced, out of stock, expired, malfunctioning, defective, or containing inaccurate information or description due to a typographical or technical error, among other reasons.

Prior to the order being shipped, the customer has the option to apply for an order cancellation. If your request for a cancellation is approved, you will be contacted by phone, email, or SMS.

  1. RETURNS AND CANCELLATION POLICIES:

13.1 CANCELLATION POLICIES:

Unless one of the exceptions listed below applies, you can cancel your order at no cost any time before we send the Dispatch Confirmation relating to that product(s).

Cancellation request may be submitted via ‘My Orders’ section of the website.

EXCEPTIONS TO THE RIGHT OF CANCELLATION:

The right of cancellation does not apply to:

1• the supply of goods made to your specifications or clearly personalized;

2• the supply of goods which may deteriorate or expire rapidly;

3• a service if SOKHER BAZAR has fully performed it and you accepted when you placing the order that we could start to deliver it, and that you could not cancel it once delivery had started;

13.2 RETURNS POLICY:

You may apply for return most new, unopened items sold and fulfilled by SOKHER BAZAR within seven (7) to ten (10) working days of receipt of delivery for a full refund of the purchase cost of the item.

SOKHER BAZAR Do Not Accept ‘Change of Mind Returns’.

Conditions applying for returns: Unless otherwise stated in this Policy:

  1. Return is applicable only if, received products-

(a) did not match invoice’s product details.

(b) were in damaged condition when received.

(c)expired; defective; malfunctioned.

  1. All item packaging, documentation (boxes, manuals, warranty cards, etc.) and certificates of authenticity, grading, and appraisal must be returned with the returned items. Packaging must be unopened and seals intact (where applicable).

iii. Items must be in new and unworn condition.

  1. Any items that, because of customer negligence, misuse or tampering are, damaged, missing parts or in unsellable condition, will not be accepted for return.

v.Products which are bespoke, have been made to measure, altered, or personalised to your specification will not be accepted for return.

  1. Any item(s) that have been resized, damaged or otherwise altered after delivery will not be accepted for return.

We will notify you via phone call, email or SMS the status of your return application.

13.3 STATUTORY RIGHTS AND REMEDIES:

In addition to any other legal rights and remedies, such as those provided by the National Consumers Rights Protection Act, our cancellation and return policies are applicable.

  1. CUSTOMER DEMERITS:

Misusing or abusing SOKHER BAZAR services, or breaking any terms and conditions, will incur you demerit points. You may be permanently or temporarily prohibited from utilizing SOKHER BAZAR services if you have three (3) or more demerit points. Below is a list of the merit point system. i. Uploading texts or photographs in the product review section that are inappropriate (illegal, obscene, abusive, threatening, libelous, invasion of privacy, violating intellectual property rights, or otherwise unpleasant or harmful to third parties): 0.50 points ii. Intentionally manipulating the Cash On Delivery system, such as posting an order for harmful motives, then not getting the order intentionally: 1.00 point.

  1. WAIVER:

We reserve the right to use our rights and remedies in any other circumstance where you violate these conditions of use, even if we do nothing in response to your violation.
